Permanent residence and Portuguese nationality are separate legal outcomes. Each requires its own application, evidence and decision. Investment residence does not guarantee either outcome.
Key considerations
- Permanent residence remains a distinct option under Article 80 of Law No. 23/2007.
- The general naturalisation rules changed on 19 May 2026. Older five-year summaries are not a safe basis for new applications.
- A pending Golden Visa application and a pending nationality application are different proceedings.
Start with the status you want
A residence permit authorises residence as a foreign national. Permanent residence changes the duration and conditions of that residence status. Nationality establishes citizenship. A passport is a consequence of citizenship and requires its own administrative process.
Plan these outcomes separately from the investment contract. A fund redemption date, the fifth anniversary of an investment and eligibility to lodge an application need not coincide. A family should also assess each person individually rather than assume that every dependent reaches the next stage on the principal applicant’s timetable.
| Question | Permanent residence | Nationality by general naturalisation |
|---|---|---|
| What is being requested? | An enduring residence status as a foreign national. | Portuguese citizenship through a separate nationality proceeding. |
| Which time test is relevant? | At least five years holding temporary residence under Article 80. | The applicable legal residence period under the Nationality Law and its transitional rules. |
| What should the file establish? | Residence history and the other Article 80 conditions. | The relevant nationality route, residence calculation and every additional condition. |
Permanent residence
Article 80 requires at least five years holding a temporary residence permit, alongside the prescribed criminal record conditions, subsistence, accommodation and basic Portuguese. The permanent status has no fixed expiry, although its residence document must generally be renewed every five years under Article 76.
For qualifying ARI holders and their families, Article 65.º-K provides a permanent investment residence category with specific exceptions to absence-based cancellation rules. The category on the decision and card matters. Ask for written advice on the applicable conditions before changing residence patterns or disposing of the investment.
Naturalisation under the current law
Under Article 6(1), the general residence period is seven years for nationals of countries with Portuguese as an official language and EU Member States, and ten years for other nationals. Applicants must also satisfy the current language, cultural and civic knowledge, declaration, criminal, security, sanctions and subsistence conditions.
The requirements are cumulative. Completing the residence period does not by itself establish eligibility. Any exemption or alternative nationality route must be identified in the legislation rather than inferred from a Golden Visa approval.
The residence record and transitional protection
The 2026 amendment repealed Article 15(4), which had credited time awaiting a temporary residence decision. Article 7(2) preserves the previous Nationality Law for nationality proceedings already pending when the new law commenced on 19 May 2026. This protection is not expressed as a blanket exemption for everyone who had already invested or applied for ARI.
Prepare a chronology showing the nationality application, if any, each residence title and its validity, renewal requests, decisions and periods potentially affected by gaps. Have the applicable law and the relevant starting point checked before treating a date as an entitlement.
Illustration: five years of residence, different decisions
Consider a hypothetical applicant whose first temporary residence authorisation began on 1 June 2021 and has remained continuous. By 1 June 2026, that person has held temporary residence for five years. That fact can satisfy the duration element of Article 80; the remaining permanent residence conditions still need to be established.
Assume the applicant has no earlier qualifying residence, no alternative nationality route and no protected pending nationality proceeding. The same five-year history would not satisfy the current general seven-year or ten-year naturalisation period. An investment made before the residence grant does not turn these separate tests into a single clock.
The useful output is two calculations, each identifying the provision, start date, counted periods and unresolved evidence. A family member whose title began later needs their own calculation.
Documents, evidence and implementing rules
The official consolidated Nationality Regulation consulted for this guide still identifies 23 July 2025 as its latest amendment. It must be read with the 2026 statute. Do not assume that an older form or checklist contains every requirement of the current law.
Confirm the operational evidence accepted for the applicable route with IRN or the professional handling the application. In particular, establish how knowledge requirements and any exemptions will be proved. Keep copies of submissions and receipts, and distinguish a filed application from an approved one.
Build a residence and nationality register
Use one row per person and per residence period. Record the underlying date exactly as it appears on the document; add a separate column for the legal significance assigned to it. This preserves the difference between evidence and the conclusion drawn from it.
Mark uncertainties openly, for example a period covered by a renewal request but not yet reconciled with the authority’s residence record. Ask the adviser to resolve that item and identify the supporting rule. A spreadsheet should make a gap visible rather than silently count it.
| Record | Details to capture |
|---|---|
| Residence history | Type of title, grant and validity dates, renewals, gaps and official references. |
| Nationality procedure | Route relied on, submission receipt, date, process number and current stage. |
| Other conditions | Available evidence for language and other applicable requirements; missing or expired items. |
| Next action | Person responsible, document or clarification required, and the date for follow-up. |
Questions to resolve before applying
- Which residence or nationality provision applies to each family member?
- Which dates count, and what document proves each period?
- Does a transitional rule actually cover the relevant proceeding?
- What must be maintained while the application is awaiting a decision?
- Would acquiring Portuguese nationality affect another nationality under that country’s law?
- What investment, tax or contractual consequences arise from the intended change of status?
