Legislative Changes and Transitional Provisions

The date of a legal change is only part of the analysis. Identify the proceeding, its stage and the transitional provision before deciding which rules apply.

Key considerations

  • New applications, pending applications and renewals can be treated differently.
  • An investment commitment is not necessarily the event that secures transitional protection.
  • Read the original amending law as well as the consolidated text.

A method for reading a legal change

Begin with the published instrument, its commencement clause and any provision governing application over time. Then identify precisely which action is under consideration: making an investment, submitting an ARI application, renewing a permit, adding a family member or applying for nationality.

Build a timeline from documents rather than recollection. Subscription agreements, bank transfers, portal submissions, fee receipts, appointments and administrative decisions record different events. A rule protecting one of those events should not be assumed to protect every later step.

The following examples explain why the distinction matters. They are not an exhaustive history of Portuguese immigration legislation.

Identify the proceeding before choosing the rule

Use this comparison as an issue list. The same household may appear in more than one row, with different documents and applicable dates. An opinion that addresses only the principal investor’s original application may leave a later family or nationality question unresolved.

The 2023 investment route reform

Law No. 56/2023 ended new applications through the former ordinary capital transfer and property acquisition routes. Articles 42 and 43 separately address earlier permits, renewals, family cases and specified pending applications. The law also provides for conversion into an entrepreneur residence category in the circumstances it describes, with the stated reduced stay requirement.

This is more nuanced than saying that every old case is unaffected. Identify the exact route, filing date, status of any municipal procedure and the decision already made. A previously marketed property or a signed reservation does not alone establish that an application falls within a protected category.

For an existing holder, preserve the original eligibility evidence and the documents submitted at each renewal. Before restructuring or selling, obtain an assessment that addresses both the transitional provision and the continuing conditions of the actual residence category.

Illustrations: similar investments, different procedural facts

Suppose one buyer signed a property purchase agreement on 5 October 2023 but first sought ARI after the route closed. Another had a qualifying ARI application awaiting an official decision when the law commenced. The agreements may look similar, yet the transition analysis begins with different procedural facts. The first buyer cannot establish pending-application protection merely by producing the contract; the second must prove the relevant pending application and satisfy the applicable conditions.

The same distinction appears in nationality. Assume two investors made investments in the same year. One had a nationality proceeding pending on 19 May 2026; the other had only an ARI file pending. The investment dates do not make their nationality positions identical. The nationality submission record determines which transition question needs to be examined.

These hypothetical examples isolate the factual distinction. Other grounds or exceptions can only be assessed from the complete file.

Nationality proceedings have their own transition

The 2026 nationality reform has a separate rule for pending nationality proceedings. It should not be confused with the 2023 protection for certain immigration cases. Refer to the citizenship guide for the current requirements and the scope of Article 7 of Organic Law No. 1/2026.

An ARI submission, approval or renewal is not a nationality submission. When a nationality application has already been made, retain its official receipt and complete file. When it has not, do not rely on the date of an earlier investment as proof that old nationality rules continue to apply.

The 2025 and 2026 procedural amendments

Law No. 61/2025 amended family reunification and added Article 87.º-B on judicial protection. Its Article 8 applies the changes in Articles 2 and 3 to administrative and judicial proceedings initiated after commencement on 23 October 2025. The ARI family exception in Article 98 must be read with the remaining family conditions.

Law No. 62/2026 made further amendments effective from 11 September 2026, including general residence procedure provisions. Its Article 10 concerns pending proceedings under the asylum law. It should not be described as a universal safeguard for all residence applications.

Legislation, regulation and published guidance

A consolidated law is useful for locating the current provision, but the source may be marked as being updated. In that situation, compare the relevant amending instrument directly. Regulations provide implementation detail; agency checklists show the evidence requested in practice. Keep the source type and date visible when comparing them.

A proposal, political announcement or court challenge does not have the same status as a commenced statute. Conversely, an old website checklist does not suspend a new law. Where the interaction is uncertain, record the uncertainty and seek a case-specific legal view instead of choosing the most favourable description.

Prepare a transition file

Prepare a short transition note before a transaction, renewal or new application. It should be understandable to someone who has not previously handled the file and should identify the decision you need to make now.

  • State the proposed action and the person or proceeding affected.
  • List the decisive dates with the document proving each one.
  • Attach the old provision, the amendment and the temporal rule relied on.
  • Separate confirmed facts from disputed dates or missing evidence.
  • Record the professional conclusion, its assumptions and any step that could change it.
  • Set a review point before signing, transferring, withdrawing or submitting anything that changes the facts.
