Processing Times, Administrative Delays and Legal Remedies

A statutory decision deadline is not a forecast of the date a residence card will arrive. Assess delay by identifying the procedural stage, the applicable deadline and the evidence in the individual file.

Key considerations

  • Track registration, document examination, biometrics, decision and card delivery separately.
  • The September 2026 amendment permits a notified exceptional extension of the general grant deadline.
  • Court proceedings require an appropriate legal basis and evidence; delay alone does not guarantee urgent relief.

Different stages, different clocks

An ARI file can involve registration, initial review, document requests, attendance, a final decision and production of the card. Waiting at one stage does not establish that a legal deadline for another stage has expired. The legally relevant start date may require examination of how and when the request was formally made.

Keep a chronology with submission receipts, payment dates, notifications, responses and appointments. A portal label such as “under analysis” is useful information about the file, but is not itself an explanation of every outstanding administrative step.

The current statutory framework

Article 82(5) of Law No. 23/2007, as amended by Law No. 62/2026, sets a general 90-day period for a grant decision, without prejudice to other statutory periods. It permits a 30-day extension in exceptional, duly justified circumstances, with notification to the applicant. Article 82(6) provides a 60-day decision period for renewals.

Family reunification has a separate regime. Article 105, amended by Law No. 61/2025, sets a nine-month period with the extension provisions specified there. The applicable version and the date the procedure began matter. These are statutory rules, not promises of end-to-end processing or card delivery.

What a missed deadline does and does not mean

A missed deadline should be examined with the rules on counting time, any request for missing information and any lawful suspension or extension. It does not automatically establish that the substantive investment and personal requirements are met.

Law No. 62/2026 repealed Article 82(7), the former provision concerning tacit approval of renewal requests. Do not rely on older summaries stating that every unanswered renewal becomes automatically approved. The legal consequences for an older file require a review of its dates and the applicable law.

Documented administrative follow-up

A focused request for information should identify the applicant and process reference, set out the relevant dates and ask what remains outstanding. The Administrative Procedure Code provides rights to information and access to the file, subject to its rules. Keep proof of the request and any reply.

Where the issue is technical, record the error and attempts to use the official channel. Where a document has been requested, establish whether it was delivered correctly. Repeated general messages are less informative than a complete chronology and a clearly identified missing step.

Judicial remedies and urgent protection

Article 87.º-B, introduced by Law No. 61/2025, places challenges to AIMA decisions or omissions within the administrative action framework, without excluding interim protection. The remedy sought must fit the omission or decision and the person’s procedural position.

The urgent procedure for protecting rights, freedoms and guarantees has additional conditions. The provision requires demonstrably serious and direct impairment of personal rights in time-sensitive circumstances, where available interim measures cannot provide effective protection. A lawyer should assess the evidence, admissibility, applicable deadlines, costs and realistic relief before proceedings are brought.

Information useful for legal assessment

Prepare a concise chronology and the complete official record. Explain the concrete effect of the delay with documents, rather than relying only on the length of the wait. A professional assessing remedies needs to distinguish an unavailable appointment, a missing decision and an approved card awaiting issue.

Court orders and judgments are fact-specific. An order requiring the administration to act does not necessarily require it to approve the application. A decision published under an earlier procedural framework should be read alongside subsequent legislation before being used as a comparison.

QuestionEvidence to assemble
What action is missing? The application reference and the last substantive notification
What has the applicant already done?Submission, payment and response receipts
What concrete effect has the delay had?Dated documents showing the individual consequence
What relief is being considered?A precise account of the action or decision sought

Practical questions

Does paying the application fee start every legal deadline?

A payment date is useful evidence, but it does not by itself resolve when a particular statutory period began. The answer depends on the type of request and its procedural history. Keep the payment receipt alongside the submission record, document requests and attendance information so the correct starting point can be assessed.

Will a court action guarantee approval?

An action may concern an appointment, an omitted decision or another specific duty. Relief requiring an administrative step does not establish that the substantive residence conditions are met. Ask what outcome the chosen procedure can legally secure, what evidence is needed and how the current procedural rules apply.
