Scientific Research Investment

The scientific research route requires capital to be applied to research activities carried out by qualifying institutions within Portugal’s national scientific and technological system.

Key considerations

  • The standard minimum is €500,000, potentially €400,000 for a qualifying low-density activity.
  • The institution’s status and the destination of the funding are central to eligibility.
  • Renewal evidence must address the continued integrity of the support provided.

The research route in law

Article 3(1)(d)(v) of Law No. 23/2007 permits a capital transfer of at least €500,000 applied to research activities developed by public or private scientific research institutions integrated into the national scientific and technological system.

The statutory description has two connected elements: a qualifying institution and qualifying research activity. A business describing itself as innovative, or a project using new technology, does not automatically meet this test. Establish the legal basis for the institution’s status and the particular activity receiving the funds.

The low-density provision

Research is one of the categories for which Article 3(2) permits a 20% reduction when the activity is carried out in a qualifying low-density territory. The reduced figure is €400,000. The relevant definition and territorial evidence must be checked for the actual research activity.

A university or institution may operate several sites. Its headquarters, the investor’s residence or the location of an administrative office may differ from where the funded activity takes place. Ask the institution to explain and document the location on which any reduced-threshold assessment relies.

Define what the funding supports

Before transfer, obtain a written description of the research, the recipient’s role, the budget, milestones and reporting arrangements. Establish whether the funding supports an existing programme or a distinct project and who has authority to accept it.

As a matter of practical review, the agreement should address permitted uses of the money, changes in the research plan, treatment of unused funds and what happens if the institution or project changes. Separate the residence purpose from any contractual expectations about publications, intellectual property, access to results or repayment.

Evidence of the completed investment

Under Article 65-D of Regulatory Decree No. 84/2007, the research institution provides a declaration confirming the effective transfer of capital. The regulation also requires the relevant bank declaration and the applicant’s declaration concerning the minimum investment and time conditions.

The evidence should be consistent across the funding agreement, bank records and institution’s declaration. Confirm the recipient’s full name, the applicant’s identity, the amount and the funded activity. If the investment is held through a permitted company structure, the ownership evidence must also support that structure.

Build a funding and reporting record

A usable record connects the legal institution, funded activity, payment and later reporting. Keep the signed agreement and project annex together with the transfer confirmation, institutional declaration and correspondence identifying the authorised signatory. This is a practical organisation method, not a substitute for the documents AIMA requires.

When a project has several funders, ask how the institution records the applicant’s contribution and its use. The aim is to avoid a file in which the total project budget is clear but the particular qualifying transfer cannot be traced.

  • Confirm that the legal entity signing the agreement is the entity receiving the payment and issuing the declaration, or obtain an explanation of any difference.
  • Record the reporting contact and an alternative contact so that personnel changes do not interrupt access to evidence.
  • Request a written process for recording changes in location, scope, budget or use of unspent funds.

Research progress and renewal

Article 65-E provides for an institution’s declaration at renewal confirming that no subsequent changes attributable to the applicant have compromised the support given. This focuses attention on continuing documentary cooperation with the institution.

Research can produce unexpected results. The legal file concerns the qualifying investment and support, while scientific success is a different issue. Agree how changes of personnel, budget, timetable or research direction will be documented and assessed. Do not assume that either a project delay or project completion automatically resolves the residence implications.

Questions for the institution and adviser

The general minimum maintenance period runs from the grant of residence under Article 65-B. The funding arrangement should therefore be examined alongside the immigration timetable, including the possibility of a gap between the transfer and the residence decision.

  • Which documents establish the institution’s integration into the national scientific and technological system?
  • Which specific research activities receive the qualifying amount?
  • Who can sign the initial and renewal declarations?
  • How will material changes and the use of funds be reported?
  • What contractual rights, if any, does the applicant receive in exchange for the transfer?
