Legal Developments and Programme Updates

Selected legal developments affecting Portuguese investment residence, with the relevant dates, official instruments and the practical questions each change raises.

Key considerations

  • Check the legal status of a development before acting on it.
  • Use the detailed guides to understand who is affected and which transitional rules matter.
  • This selected chronology is not an exhaustive legislative monitoring service.

September 2026: further immigration procedure changes

Law No. 62/2026 was published on 10 September and commenced the following day. For general residence grants, the amended Article 82(5) provides for a 90-day decision period and a possible notified 30-day extension in exceptional, justified circumstances. The law also repealed the former Article 82(7) rule on tacit approval of renewals.

Affected readers: applicants assessing a delay and holders relying on older renewal guidance. Record the procedural stage, submission and response dates, any extension or request for information, and the precise rule being relied on. Use the processing guide to distinguish a statutory decision period from the time required to receive a card. The consequences for an older file require its own temporal analysis.

May 2026: the nationality framework changes

The Ministry of Justice confirmed the entry into force of the nationality reform on 19 May 2026. The general residence periods and other naturalisation requirements changed. The permanent residence and citizenship guide explains the distinction between the current route and protected pending nationality proceedings.

Affected readers: anyone using an earlier nationality timetable, especially an investor who has not yet filed a nationality application. Identify whether a nationality proceeding was already pending at commencement, then prepare a separate residence history for each person. This establishes the facts needed to determine the relevant framework before commissioning further documents.

October 2025: family and judicial protection rules

Law No. 61/2025 introduced changes to family reunification and judicial protection. For ARI families, the specific statutory exception must be considered alongside the remaining conditions, rather than applying the general family waiting rule in isolation.

Affected readers: families preparing an application or renewal, and applicants considering judicial proceedings. Check the exact family category, the remaining evidence requirements and the dates on which the administrative and judicial proceedings began. An exception from a waiting period does not resolve the other family eligibility conditions.

January 2024: changes to the procedural regulation

Regulatory Decree No. 1/2024 amended the regulation implementing the immigration law, including investment residence provisions. The regulation is part of the legal framework behind documentary checks and the handling of applications.

Affected readers: applicants assembling evidence and holders preparing renewal records. Compare the documents available with the applicable regulatory provision and current AIMA instructions. Record who will issue each declaration and which period it covers, particularly where investment evidence depends on a manager, institution or beneficiary.

October 2023: the investment route reform

Law No. 56/2023 reshaped the available investment routes and included provisions for earlier and pending cases. The investment routes and transitional rules guides distinguish the routes open to new applications from the treatment of earlier cases.

Affected readers: new investors comparing routes and holders of earlier property or capital-transfer files. New applicants should use the current route comparison. Existing applicants should locate the original filing evidence, grant and renewal decisions, and any relevant municipal procedure before relying on a transition provision.

Keep a record of the effect on your own file

For a material development, write a brief entry with four elements: the official source and effective date; the step in your file potentially affected; the document or fact still needed; and the person responsible for resolving the question. Link the entry to the relevant application or investment record.

For example, a hypothetical holder reading a new renewal notice might record that the published channel has changed, that their card expires in a particular month, and that they need to verify whether that expiry group is covered. This produces a concrete administrative question without assuming that every notice applies to every holder.

Keep the resulting answer with its date. If an authority later changes the instructions, the record helps explain what was done and why. A selected legal chronology supports this process, while the official source remains the place to verify the current instruction.

How to assess the next development

When reading a news item, record the issuing institution, instrument number, publication date, commencement date and source link. Identify whether it describes a proposal, an approved but unpublished text, a published law, a regulation, a court judgment or an administrative notice.

Then ask a narrower question: which step in this file could be affected? A headline about immigration may concern asylum, ordinary employment residence or nationality rather than ARI. Follow the relevant primary instrument and avoid treating a draft or an announcement as a completed legal change.

Corrections to this chronology can be submitted through the editorial contact. Include the primary source and the passage concerned so that the point can be checked against the underlying text.
