Residence Rights and Travel within Schengen

A Portuguese residence authorisation and permission for a short visit elsewhere in Schengen are distinct. Understand where the permit provides residence rights, what documents travel requires and how short stays are counted.

Key considerations

  • ARI provides residence rights in Portugal, subject to the applicable conditions.
  • Visits to other Schengen countries generally remain limited to 90 days in any 180-day period.
  • A Portuguese residence permit does not by itself authorise living or working in another EU country.

Residence and work in Portugal

Law No. 23/2007 sets out the rights associated with holding a residence authorisation, including access to employment, self-employment, education, health and the courts under the applicable legal rules. ARI is one route to Portuguese residence. It does not remove the sector-specific conditions for a regulated profession or every administrative formality connected with living in Portugal.

Immigration status and access to a particular service are separate questions. Registration, coverage or eligibility conditions may need to be satisfied for healthcare, education or other services. A residence card should not be described as a blanket guarantee that every service is free or immediately available.

Short visits to other Schengen countries

A valid residence permit issued by a Schengen country generally allows travel to other Schengen countries for short stays of up to 90 days in any 180-day period. Travel remains subject to the applicable entry conditions, including a valid travel document, the purpose of the visit and sufficient resources where required.

The short-stay allowance applies across the other Schengen countries together. It is not a separate allowance for each destination. A journey from France to Spain does not restart the clock. Keep a record of the days spent outside Portugal and check the position for the entire itinerary.

Understanding the rolling period

The 180-day period is rolling: for any day of a short stay, look back over the relevant 180 days and count the days that fall within the short-stay allowance. The European Commission provides a calculator to assist with this calculation. The tool is an aid and does not replace the legal conditions or a border decision.

For example, several separate holidays or business visits can use the same allowance. An applicant planning a lengthy visit should consider earlier trips before booking, rather than looking only at the length of the next journey. Residence in Portugal under a valid Portuguese permit must be distinguished from short visits elsewhere.

Employment and relocation to another country

Short-visit permission is not general employment authorisation. Before taking up work, providing services or moving to another country, check that country’s immigration and employment rules. A destination may require its own visa or residence permit for a longer stay and additional permission for the activity.

European Union citizenship, Portuguese permanent residence and EU long-term resident status are different legal categories. They should not be treated as interchangeable benefits of a temporary ARI card. Even where a separate mobility regime exists, its conditions and the second country’s procedure must be examined.

Documents to carry and check

Carry the valid passport or travel document and the valid residence permit, and check the requirements of the destination and any transit country. The absence of routine checks at an internal Schengen border does not remove the obligation to hold appropriate documents.

Check names, expiry dates and the implications of a replacement or missing card before departure. If the residence document has expired, do not assume that a Portuguese renewal receipt or domestic extension will be recognised by an airline or another state. Obtain confirmation for the documents and route actually being used.

Destinations outside Schengen

The European Union and the Schengen area are not identical. For a destination outside Schengen, check its own visa and entry rules based on nationality, travel document, purpose and residence status. A Portuguese card may be relevant to a particular exemption, but it is not a universal travel permission.

When planning travel, keep the short-stay calculation separate from ARI minimum-presence obligations and any tax-residence analysis. The same journey can affect each question differently. A clear itinerary and documentary record make those separate assessments easier.

Practical questions

Does travelling to a second Schengen country give me another 90 days?

No. The short-stay allowance in the other Schengen countries is combined. For example, visits to France and Spain within the same relevant period are assessed together, not against a separate allowance for each country. Keep one travel record for the full itinerary.

Can I work remotely during a short visit?

Do not assume that permission to enter for a short visit authorises every form of work. The activity, duration and destination’s rules matter, and employment or tax questions can arise separately from border entry. Check the intended activity with the authorities or a suitably qualified professional in the destination before relying on the Portuguese permit.

What if my renewal is pending when I need to travel?

Identify the documents you will actually hold on the travel dates. Check their acceptance with the destination and transit authorities and the carrier, including the return journey to Portugal. The fact that a renewal is pending does not by itself establish that the same documents will be accepted throughout the itinerary.
